The County Clerk's office emphasizes serving the citizens of Clay County with integrity, responsibility, and efficiency.
The duties of the County Clerk include:
- Maintaining complete and accurate records of the County Commission
- Collecting fees and issuing licenses (liquor, amusement & firework, auctioneer, wrecking & towing)
- Swearing in notaries
- Processing accounts payable
- Notarizing documents
- Performing secretarial duties for the Board of Equalization (BOE)
- Billing railroad and utility companies in Clay County
- Certifying levy rates

Licenses and Permits
The Clay County Clerk's Office is responsible for issuing a variety of permits. If you need to apply for a license, please review the process and requirements below.
PER State Statute 343.010:
Auctioneers must have license--auctioneer defined.
343.010. 1. No person shall exercise the trade or business of a public auctioneer by selling any goods, property or real estate, without a license.
2. "Auctioneer", as used in section 150.380 and sections 343.010, 343.070 to 343.105 is one who sells goods, merchandise, or property of any kind, at public or private auction, for another person, and who receives any commission or compensation of any kind for conducting such sale; but not including one who conducts such a sale by or under the jurisdiction of any court, or pursuant to any judicial judgment or order, or any foreclosure sale of real estate, and not including any owner of any goods, merchandise or property of any kind, who himself conducts such sale. NOTE: The Auctioneer license is issued to each auctioneer and not company. An auctioneer license issued in any county of this state shall be valid in each county of this state during the period for which it is issued. If an auctioneer is found to conduct business the following penalty shall be exercised to the fullest extent.
343.250. Every person who shall violate any of the provisions of this chapter is guilty of a misdemeanor, and, upon conviction, shall be punished by a fine of not less than twenty nor more than five hundred dollars, and shall be disqualified from exercising the rights or pursuing the business of an auctioneer for a period of one year from the date of his conviction. After January 1, 1979, every person who shall violate any of the provisions of this chapter is guilty of a class C misdemeanor and shall be disqualified from exercising the rights or pursuing the business of an auctioneer for a period of one year from the date of his conviction. If you wish to apply for a servers license please contact the City Hall for the city you wish to work in. Clay County does not provide individual server liquor licenses.
If you are establishing your business to serve or work with alcoholic beverages you will need to contact the State Liquor License Control in Jefferson City as well as work with the City for which your business or event takes place. The county is required to collect fees that of the state as state statute says that the County SHALL collect the fees. The clerk's office does review and attempt to update the fees per the state listing.
The Clerk's Office can not issue a license until you have applied and received your license from the state. When you have received your documentation from the state stating which license(s) you have obtained please submit a copy to our office via mail, fax or email and our licensing specialist will work with you to obtain the county license required. The fees generally are the same fees as the state and an additional $3.00 statutory required fee for license processing.
Please note that you are required to pay as soon as you receive your state confirmation or penalties and legal action may be able to be made. Such actions can cause all licenses to be revoked and require reapplication and fees in full for both the state and city, and suspension of liquor sales. Contact the Clerk's Office for assistance to ensure that payment is being processed in a timely manner.

RENEWALS will be sent minimum 30 days prior to deadline. It is the responsibility of the license holder to contact us for assistance to pay and submit on time. Annual licenses are due July 1 of each year and covers July 1st to June 30th.

Wrecking and Towing Service License
In accordance with RSMo 301.344, any wrecker or tow service business that resides in or operates more than 50% of its business in Clay County must obtain a Wrecker and Tow Service License.
Any company found to provide services but do not meet the requirements (less than 50% of business) as noted above must complete the affidavit portion of the form for the clerk's records.
Any company not compliant with their county taxes and license fees may not be used in the Sheriff rotation for towing and service. In addition, any business found in non-compliance may face additional monetary and legal penalties.
If your business is required to file and application/affidavit with the clerk's office then complete the application below and submit with the proper documentation and payment to the Clay County Clerk's office.

The County Clerk is responsible for the local processing of notary public commissions.
Applicants must first apply with the Missouri Secretary of States Office, Commissions Division.
Once approved by the state the applicant needs to obtain a surety bond. The bond then MUST BE REMITTED to and verified by the clerk's office in order for the applicant to receive his/her oath and commission. The bond will be submitted to the Secretary of State Office of Commissions to show completion and receipt of oath.
